1. Definitions

• "Platform" means the Makelaa website, mobile app, and all related services.
• "User" refers to any individual accessing the Platform (buyer or seller).
• "Buyer" means a user purchasing goods on Makelaa.
• "Seller" means a user approved by Makelaa to list and sell products.
• "HBM Fulfillment" refers to Makelaa's third-party U.S. fulfillment partner.
• "Seller-Fulfilled" means sellers who store and ship their own inventory.

2. Marketplace Model

Makelaa operates as a multi-vendor marketplace, not a retailer. Products are sold by independent sellers.

Makelaa facilitates:

• Payment processing
• Order management
• Communication between buyer & seller
• Fulfillment through HBM (when applicable)
• Customer support and dispute resolution

Makelaa does not manufacture the goods sold on the platform.

3. Account Requirements

To use Makelaa, you must:

• Be at least 18 years old
• Provide accurate and complete account information
• Maintain the security of your login credentials
• Comply with U.S. laws and Makelaa's policies

Makelaa may suspend or terminate accounts that violate these Terms.

4. Communication Policy

Buyers cannot contact sellers directly.

All communication is handled by Makelaa Support to ensure:

• Safety and privacy
• Clear documentation
• Professional conflict resolution

Sellers are prohibited from including personal contact information, external links, or attempts to transact outside Makelaa.

5. Payment & Transaction Processing

All payments are processed securely through Makelaa using approved U.S. payment methods.

Makelaa is not responsible for:

• Bank delays
• Payment failures caused by insufficient funds
• Incorrect information entered by users

Fees may apply for sellers based on their membership tier or service usage.

6. Prohibited Activities

Users may not:

• Post false or misleading information
• Attempt to transact outside Makelaa
• Reverse engineer or disrupt the Platform
• Upload harmful software or engage in fraud
• Harass Makelaa staff or sellers
• Sell illegal, stolen, or unsafe items

Violation may result in immediate account suspension.

7. Disclaimer of Warranties

Makelaa provides the Platform "as is" and "as available."

We do not guarantee:

• Continuous access
• Error-free operation
• Availability of any seller or product

Sellers are solely responsible for the products they offer.

8. Limitation of Liability

To the maximum extent permitted by law:

• Makelaa is not liable for any indirect, incidental, or consequential damages
• Makelaa's total liability will not exceed the amount paid by the buyer for the product

Buyers and sellers agree to use Makelaa at their own risk.

9. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.
